Wittekind vs. Rusk becomes hilarious when it is viewed with the facts
The facts are
1. Defense of the plaintiff was supported by the probable cause when the statement
of facts on the mind of Judge Brinn were used to completely impeach all three of the
State's witnesses with prior inconsistent statements. Exhibits at:

2. A probable cause as reckless as the probable cause held
against me becomes evidence of malice as proven by the argument that "Reversed and
Remanded" the very precedent that misguided Judges in the Appellate Court below used
as the basis for their decision.

These Judges claim there was "no valid basis for attack on judgement" but in reality the "valid basis" was that Duane Thompson had recreated the exact "Errors of Law" that "Reversed and Remanded" the Mack case when he failed to state properly the decision of the Appellate Court in the Mack case after he concealed evidence of malice with his objections. |
Below, about half way down on the left hand side it says: "supported by probable cause" but they overlooked the fact that I used the "probable cause" as the statement of facts on the mind of Judge Brinn to completely impeach all three of the State's witnesses with prior inconsistent statements. The alleged "probable cause" was in reality "Evidence of Malice" as proven by the argument in the very case these judges claim supported a "directed verdict." |
All Duane Thompson had to do to get is name into three law books was to was use objections to conceal evidence of "Malice", use deceptions to conceal evidence of a "Total Lack of Good Faith" and then ask for a "Directed Verdict" using a legal precedent that was "Reversed and Remanded" because objections concealed evidence of "Malice" and deception concealed evidence of a "Total Lack of Good Faith!" |
The judgment above is based on the reckless
disregard of the facts by three other judges that unfairly manipulated testimony when they
